These Terms and Conditions of Use (“Terms”) govern the purchase, access, and use of all physical books, digital books, PDF downloads, and other publications (each, a “Book”) provided by PennWell Books, LLC (“PennWell Books,” “we,” “our,” or “us”).

By purchasing, accessing, downloading, or using any Book or service offered by PennWell Books, you (“User” or “Customer”) agree to be bound by these Terms.

If you do not agree to these Terms, you should not purchase or use any PennWell Books products or services.

1. General Terms of Use

Access to or use of any Book constitutes acceptance of these Terms.

PennWell Books reserves the right to modify, update, or replace these Terms at any time without prior notice. Updates may be posted on the PennWell Books website. Continued use of our products or services following any modification constitutes acceptance of the updated Terms.

Unless otherwise expressly permitted in writing, the rights granted to Users under these Terms are non-transferable and non-exclusive.

If a User objects to any portion of these Terms or any future modification, the User’s sole remedy is to discontinue use of the Book or service.

2. Product Types

PennWell Books offers both physical and digital products, including but not limited to:

  • printed books
  • eBooks
  • downloadable PDF files
  • digital publications
  • bundled content

Additional terms may apply to certain digital products.

3. Orders and Purchases

All purchases made through the PennWell Books website constitute an offer to purchase a product.

PennWell Books reserves the right to accept or reject any order at its sole discretion. If an order is rejected after payment has been processed, the applicable purchase price will be refunded.

Prices, product descriptions, and availability may change at any time without notice.

PennWell Books makes reasonable efforts to ensure that product information displayed on the website is accurate; however, errors may occasionally occur.

4. User Accounts

Customers may create accounts when purchasing products or accessing digital content.

Users are responsible for maintaining the confidentiality of their account credentials and for all activity occurring under their account.

Users agree to notify PennWell Books immediately of any unauthorized use of their account or suspected breach of security.

PennWell Books reserves the right to suspend or terminate accounts that violate these Terms.

5. Intellectual Property Rights

All Books and related materials—including text, graphics, illustrations, photographs, designs, and other content (“Content”)—are the property of PennWell Books or its licensors and are protected by United States copyright law, international treaties, and other applicable intellectual property laws.

Purchasing or accessing a Book does not transfer ownership of the intellectual property contained within the Book.

All rights not expressly granted in these Terms are reserved by PennWell Books.

6. Authorized Use of Content

Books are provided for the User’s personal, professional, or educational use.

Except as permitted under applicable copyright law, Users may not:

  • reproduce or copy the Book
  • distribute the Book to third parties
  • upload or post the Book online
  • modify or create derivative works
  • publicly display or perform the content
  • transmit the content electronically
  • remove or alter copyright notices or author attributions

Unauthorized use of Book content may violate copyright law and may result in legal action.

7. Digital Book Licensing (Important)

Digital books, ebooks, and downloadable PDF files are licensed to the purchaser for individual use only.

The purchaser may download and store the file for personal use on their own devices.

Users may not:

  • share digital files with others
  • distribute files through email, websites, or file-sharing services
  • upload files to cloud storage for public access
  • post digital books on forums, repositories, or academic networks
  • reproduce digital books for resale or redistribution

Unauthorized distribution of digital books is strictly prohibited and may constitute copyright infringement.

8. Resale and Distribution

Users may not sell, sublicense, lease, or distribute the Book or its content to any third party without prior written consent from PennWell Books.

Any permitted copies must retain all copyright notices and proprietary markings.

9. Shipping and Digital Delivery

Physical books are shipped according to the shipping policies published on the PennWell Books website.

Digital products are typically delivered via:

  • download links
  • redemption codes
  • third-party ebook platforms

Delivery timing may vary depending on the product type.

PennWell Books is not responsible for delivery issues caused by incorrect email addresses, spam filtering, or technical issues beyond our control.

10. Warranty Disclaimer

ALL BOOKS AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PENNWELL BOOKS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT

PennWell Books does not guarantee that any Book will be error-free, uninterrupted, or free from technical defects.

11. Limitation of Liability

To the fullest extent permitted by law, PennWell Books shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use any Book.

This includes, but is not limited to:

  • lost profits
  • lost business opportunities
  • data loss
  • economic damages
  • physical harm

In no event shall PennWell Books’ total liability exceed the amount paid by the User for the Book during the three (3) months preceding the event giving rise to the claim.

Use of the Book is at the User’s sole risk.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Oklahoma, without regard to conflict of law principles.

Any legal action relating to these Terms shall be brought exclusively in the federal or state courts located in Tulsa County, Oklahoma.

13. Entire Agreement

These Terms constitute the entire agreement between PennWell Books and the User concerning the purchase and use of Books and related services.

They supersede any prior agreements, communications, or understandings, whether written or oral.

Failure by PennWell Books to enforce any provision of these Terms shall not constitute a waiver of that provision.

14. Changes to Terms

PennWell Books reserves the right to update or modify these Terms at any time.

The most current version will always be available on the PennWell Books website.

Continued use of PennWell Books products following any update constitutes acceptance of the revised Terms.
